Should you be caught not obeying the new rulings you will be fined $298, with a loss of 3 demerit points. Should the infringement occur in a school zone, the fine will be $398 with a loss of 4 demerit points.
The commander of the NSW Police Force's Traffic and Highway Patrol, Assistant Commissioner John Hartley said “the new laws make it clear that a driver cannot hold a phone in his or her hand, other than to pass it to a passenger. Under the new laws, drivers cannot rest mobile phones on their legs or hold it between their shoulder and ear."
Texting and emailing whilst driving remains illegal. Also, with learner and P1 drivers, the law remains the same and these drivers are not permitted to use any function of the mobile phone whilst driving or riding.
